Springfield, IL September 1, 2010: The County of Sangamon Circuit Court has scheduled an Emergency Motion before Judge Graves in Courtroom 5D in the Sangamon County Courthouse on Wednesday at 10AM (September 1st).
The campaigns for Illinois Governor Candidate Michael White and United States Senate Candidate Will Boyd announced their campaigns have field a joint action in the courts to sustain the viability of their candidacies. Tuesday afternoon, White and Boyd filed paperwork in the Sangamon County Courthouse as they believe they were both removed from the November General and Special Election Ballots without compelling reasons. The Lake County Illinois gubernatorial candidate and the Bond County U.S. Senate candidate met in Springfield on Saturday to begin their legal action and remain in the capitol championing “free and equal ballot access”. The nature of their action is upon the fact that the processes leading to an election have prevented alternative and independent parties from making the ballot.
Within documents served to the Secretary of State, Attorney General and Chairman of the State Board of Elections, the candidates explained that State Statutes used in the removal of both their names from the ballot were written in Illinois law in 1876 and are as confederate as an oath by Jim Crow. White and Boyd explain the way in which candidates are removed from Illinois ballots is unconstitutional. Boyd, a former Dean, adjunct college professor, protestant bishop and city councilman stated, “To apply such a test and standard today is plainly unconstitutional and should not continue.” Boyd went on to explain how such practices violate the seventeenth and the twenty-fourth Amendments of the United States Constitution relating to the election of senators. Illinois law states, “Nothing in this article [challenges] contained shall be construed to prevent the nomination of independent candidates by petition”
